Fraud Warning

Banco Sumitomo Mitsui Brasileiro S.A. (“SMBCB”) hereby informs its clients and the public in general that SMBCB does not offer (nor authorizes) any banking services or alike through third parties, representatives, intermediary agents and/or proxies, who do not hold an evidenced relationship with SMBCB, as well as, in any case, through platforms, apps, third party websites or any other social media, such as, but not limited to, instant message apps or any social medias (such as WhatsApp, Telegram, Instagram, etc.) or emails.

Accordingly, SMBCB has identified certain malicious acts inadvertently performed by third parties using SMBCB’s name and/or its shareholders, administrators and employees, mainly in public websites, reason why SMBCB hereby informs its clients and the public in general that any loan offers (including payroll-linked loans), credit facility proposals, banking services, including and any other services not provided by SMBCB, such as supposed cryptocurrency negotiations, and/or supposed auctions made under SMBCB’s name and/or by using any of its (or company’s within SMBCB’s economic group) property rights (including, without limitation, initials, logo) or registration data (CNPJ and address), with or without prior payment of any fee of any nature, including money or cryptocurrency transfer, which is presented by any third parties, must be immediately disregarded.


SMBCB’s products, as described in this website, require a prior registration which is not available online, reason why SMBCB shall not be liable for any losses in connection therewith. In this fashion, SMBCB hereby clarifies that (i) it does not require any fee in advance for any end at all, as well as does not perform nor possess any company which practices auction services, cryptocurrency negotiations or of similar nature, (ii) it does not perform any investment recommendation through instant message apps and social media, (iii) it does not perform bank transactions natural or legal persons that are not SMBCB’s customers for individuals, and (iv) it does not act with legal entities which are not previously registered nor approved by SMBCB pursuant to the applicable laws and regulations and (iii) all SMBCB’s products require a client registration that is not available online, therefore not being liable for any losses in connection therewith.


SMBCB shall not be liable for any incident deriving from the means above, as well as informs that all legal and other applicable actions had been and/or are being taken by SMBCB aiming at assessing the related facts and identifying the fraudsters so that to guarantee SMBCB’s soundness before the market as a whole. Likewise, we recommend that you do not make any payment nor inform any data (mainly, personal ones) to the individuals or companies who allege to work for SMBCB.

Anti-Fraud Regulation

In accordance with Joint Resolution No. 6, of May 23, 2023, which will come into force on November 1, 2023, as well as in compliance with other applicable laws and regulations, we use this to inform you that the SMBCB will opportunely update the General Provisions of its Registration Form to include the clause described below:


5. Pursuant to Joint Resolution No. 6, of May 23, 2023, the Customer acknowledges and declares that it is aware that the BANK may record and process its data and information, related to occurrences, attempts and/or signs of fraud, with the purpose of preventing fraud and ensuring the security of operations and the stability of the National Financial System. 5.1. To this end, and in accordance with the laws and regulations relevant to the matter, including, without limitation, Complementary Law No. 105, of January 10, 2011, as amended, and the General Personal Data Protection Law of Brazil (LGPD), No. 13.709/2018, the Customer authorizes the BANK to share said data and information with Authorized Entities, with financial institutions, payment institutions and other institutions authorized to operate by the Central Bank of Brazil, as well as with possible suppliers, if necessary for the purposes of complying with said standard.

Portability

Banco Sumitomo Mitsui Brasileiro S.A. ("SMBCB") informs its clients that everyone has the right to the portability of credit operations, pursuant to CMN Resolution No. 5,057 of December 15, 2022. The exercise of the portability is initiated by the client upon request, through the Credit Description Document ("DDC") to be delivered to SMBCB, as responsible for its loan and / or financing. The DDC will enable the execution of portability to the financial institution desired by the customer and its effectiveness will depend upon the fulfillment, by the client, of the instructions provided by the SMBCB’s relationship manager during the process.
